Experience

Donald Carbone heads Goetz Fitzpatrick’s Construction Litigation Group. Over more than four decades of practice, he has developed extensive experience in construction law, contract and surety law, commercial leasing and real estate, labor law, and corporate, commercial, and business transactions.

In all these areas, Donald takes responsibility for both the transactional and dispute resolution phases, handling numerous complex disputes involving millions of dollars in both the public and private sectors of state and federal courts, in mediation, before the American Arbitration Association, and in appeals. He represents all facets of the construction and real estate industries encompassing owners, developers, tenants, general contractors, subcontractors, specialty contractors, design professionals, manufacturers, suppliers, and sureties/insurers, and is listed as counsel of record in a multitude of reported cases across the trial and appellate courts in both the State and Federal Court systems.

Donald has handled numerous complex disputes, many of which have been published in New York State caselaw digests, involving partnership, joint venture, shareholder and member agreements, buy-outs, cost overruns, design defects, defective work claims, scope of work claims, extra work and change orders, delay damages, lost profits, loss of productivity, out-of-sequence work, suspended work and interference claims, surety claims, mechanic’s liens, payment and performance bond claims, site work, concrete foundations and sub-surface claims, heavy highway construction claims, utility interference claims, wrongful termination, prevailing wage, and union benefit claims.

As a Goetz Fitzpatrick veteran, Donald’s approach leads the firm’s culture. He gives clients an honest evaluation of their case and educates them on options, guiding them toward the most practical strategy to achieve a resolution that is in line with their goals via the most timely and cost-effective method available. He has been a guest lecturer in various construction trade associations and a main presenter at Lorman Seminars on construction law. Donald’s committee and association affiliations reflect his broad range of skills.
