John B. Simoni, Jr. specializes in construction law, professional liability defense, commercial litigation and labor and employment issues arising in the construction industry. He enjoys providing contract and business formation advice as well as handling claims, trials, arbitrations, litigation and appeals on behalf of owners, developers, contractors, subcontractors, architects, engineers, construction managers, bond sureties, and others in the construction industry. John has received the distinguished A-V Peer Review Rating from Martindale Hubbell and the "Super Lawyer" designation for the New York Metropolitan region.
John's experience includes public sector projects, large and small private commercial projects, large scale single family home residential projects and apartment renovations. Some of the most noteworthy litigation he has handled includes representing a developer in a product liability claim of $4.9 million against a storm water drainage manufacturer within a bankruptcy court adversary proceeding; representing a world renowned soils engineer against $30 million dollars in state and federal court claims involving the failure of a massive concrete retaining wall; and representing a large public works contractor against millions in alleged unpaid prevailing wage and benefit claims.
During his years in practice, John has actively participated in various industry associations including the American Institute of Architects (Professional Affiliate), the Building Owners' and Managers' Association of Greater New York, Inc. (Member, Codes and Regulations Committee), the New York Building Congress (Member), the Metropolitan Design Professional Legal Roundtable (Member), the American Bar Association (Member, Forum on the Construction Industry), the Association of the Bar of the City of New York (Member), the New York County Lawyers Association (Member) and the New York State Bar Association (Member, Environmental Law Section).
John has also been a guest lecturer for New York University's Real Estate Institute Diploma program, has given seminars on contracts and liability issues for members of the American Institute of Architects, and frequently presents as a speaker for educational seminars relating to construction.
He is licensed to practice law in the state, federal and bankruptcy courts in New York, New Jersey, Virginia, Maryland and the District of Columbia. He received his Juris Doctor degree from the University of Richmond and his undergraduate degree from Hobart College. Mr. Simoni also served briefly in our federal government for the U.S. Department of Labor. He is originally from Saratoga County and is the proud father of two children.
